Registrar’s Decision

19-05-004

File Number: 19-05-004

In the matter of Motor Dealer Act R.S.B.C. 1996 C.316
and Salesperson Licensing Regulation B.C. Reg. 202/2017

Complainant: Vehicle Sales Authority of BC

Licensee/Unlicensed person:

Justin Kyle Plosz

Issues:

Mr. Plosz applied for a salesperson licence.
Mr. Plosz has an extensive criminal record of concern.
Mr. Plosz has pending criminal charges of a similar nature that stem from a vehicle transaction, which is directly related to this industry.
Mr. Plosz failed to advise the VSA of his then forthcoming Alberta Motor Vehicle Industry Council (“AMVIC”) administrative review of his salesperson licence in Alberta.

Outcome:

The Registrar found that Mr. Plosz’s past criminal convictions, his being refused a salesperson licence in Alberta, and his failing to advise the Authority of his AMVIC review indicate that he cannot be trusted.
The Registrar found that Mr. Plosz cannot be trusted to act with honesty and integrity and this also raises a concern about his governability.
The Registrar refused to licence Mr. Plosz as a salesperson at this time.
The Registrar will not accept an application for licensing or registration under the Motor Dealer Act from Mr. Plosz for a period of three years from the date of this decision (October 22, 2022) – subject to the 2017 criminal charges having been addressed.
