Licensee/Unlicensed person:

N.W. Auto Depot Ltd (#10578), Westminster Motors Ltd. (#40469), Gordon Valente (#101221)

Issues:

Alleged that the N.W. Auto Depot, Ltd., Westminster Motors, and Gordon Valente (“Dealers) breached the Consignment Sales Regulation and engaged in deceptive acts and practices
Alleged that the Dealers failed to comply with the conditions imposed on its registration on May 24, 2018 and offered motor vehicles for sale that were not suitable for transportation under the Motor Vehicle Act of British Columbia
Alleged that the Dealers breached the Motor Dealer Act of British Columbia and section 189(5) of the Business Practices and Consumer Protection Act
Alleged that the Dealers failed to comply with the Registrar’s September 18th, 2018 interlocutory suspension order

Outcome:

In this liability phase of the hearing, the Deputy Registrar made the following findings:
The Dealers and Mr. Valente breached section 2 of the Consignment Sales Regulation and engaged in deceptive acts or practices
The Dealers and Mr. Valente breached the Motor Dealer Act of British Columbia by failing to make required declarations
The Authority has not proven that N.W. Auto Depot failed to comply with conditions imposed on May 24th, 2018; however, the Authority has proven that the Dealers failed to obtain inspection reports that conformed with the required standards in breach of the conditions
