Complainant: Vehicle Sales Authority

Licensee/Unlicensed person:

A Vancouver Auto Ltd. (Proposed Dealer Licence #40336) and Shahram Moghaddam (Proposed Salesperson Licence #101801)

Issues:

• A Hearing was called to review the application submitted by Shahram Moghaddam to register A Vancouver Auto Ltd. as a motor dealer and an application by Shahram Moghaddam personally for a salesperson licence.
• On October 15, 2008, the Registrar rendered a decision involving Vancouver Auto Leasing Ltd. (Dealer #30407) and Mr. Moghaddam and ordered the dealer and salesperson licence of Mr. Moghaddam remain suspended and that a hearing be held to re-issue any licence.
• Vancouver Auto Leasing Ltd. closed and Mr. Moghaddam left the industry and has been away from the industry for eight years.

Outcome:

• The Registrar reviewed the evidence from the Authority, Mr. Moghaddam and the documents provided.
• The Registrar was satisfied on a balance of probabilities that the public would be at an unacceptable risk if Mr. Moghaddam was allowed to operate a motor dealership and denied his application to register A Vancouver Auto Ltd. as a motor dealer.
• The Registrar was concerned in granting Mr. Moghaddam a salesperson license as he misunderstands his legal obligations to consumers regarding misrepresentations.
• Considering the Registrar’s decision in 2008, Mr. Moghaddam needs to show some history and evidence of good behavior. Being away from the industry for eight years is not evidence of good behaviour.
• The Registrar refused to issue Mr. Moghaddam a salesperson licence and would consider receiving another application once he has rebuilt his history of good behavior that can be verified by evidence. The registrar required two years of evidence of good behaviour from the date of the decision, before Mr. Moghaddam could reapply and be considered for a salesperson licence.
